A bench comprising Justices Siddharth and S.C. Sharma further ordered the District Magistrate to file an affidavit of compliance by January 6, 2025, warning of personal appearance in case of non-compliance.
The petition alleged that the student—a Class 3 student and two siblings—were expelled in September 2024 by Principal Avnish Kumar Sharma after he objected to them bringing non-vegetarian food to school. As reported by Live Law the plea also argued that the actions of the school administration violated the student's rights under Article 17 of the Indian Constitution, which prohibits untouchability, as well as Sections 5 and 6 of the Protection of Civil Rights Act, 1955.

Adding to the controversy, a video of a confrontation between Principal Sharma and the children’s mother surfaced on social media. The counsel for the petitioners emphasized that the expulsion had adversely impacted the children’s fundamental right to education, guaranteed under the Right of Children to Free and Compulsory Education Act, 2009.
The matter is scheduled for a fresh hearing on January 6, 2025, where the compliance report will be reviewed.
